Agreement to Terms
Welcome to Outsync®. These Terms of Service ("Terms") govern your use of our mobile application and services. By accessing or using our app, you agree to be bound by these Terms.

These Terms include specific provisions based on how you authenticate with our service. If you do not agree to these Terms, please do not access or use our service.
Service Description
Outsync is a mobile application that helps users discover, plan, and schedule outdoor activities. Our service includes:

Personalized trail discovery and recommendations

Weather and gear information for planned activities

Activity scheduling, reminders, and informational updates

Integration with Google Calendar and Apple Calendar
-
User profile and preference management
-
Trail content imported from third-party services that you choose to share into Outsync
-
User-generated content including ratings, notes, and photos

Push notifications and in-app notifications
We may add, modify, suspend, or discontinue features at any time with reasonable notice. Future features may include health platform integrations, community and social features, advertising-supported services, and merchandise. Your continued use of the service after a feature is added or changed constitutes acceptance of these Terms as applied to that feature.
Account Registration and Authentication
To use certain features of our service, you must create an account using one of the following methods:
Google Authentication. When you use Google Sign-In, you also agree to Google's Terms of Service and Privacy Policy. We integrate with Google Calendar with your explicit permission.
Sign in with Apple. When you use Sign in with Apple, you benefit from Apple's privacy protections. You control what information is shared with us, and you can use Apple's private email relay service.
Email Authentication. You are responsible for maintaining the security of your password and account. Use a strong, unique password and enable any additional security features we may offer.

Accept responsibility for all activities under your account
Acceptable Use Policy
You may not use our service to:

Violate any applicable laws, regulations, or third-party rights

Share false, misleading, or harmful content

Attempt to gain unauthorized access to our systems or other users' accounts

Distribute malware, viruses, or other malicious code

Interfere with or disrupt our service or servers

Use our service for commercial purposes without authorization

Harass, abuse, or harm other users

Reverse engineer or attempt to extract our source code

Import, share, or upload content that you do not have the right to share

Upload content that depicts identifiable individuals without their consent
We reserve the right to investigate violations and take appropriate action, including content removal, account suspension, or termination.
Trail Data and Third-Party Content
Outsync’s Curated Trail Dataset. Outsync provides a curated dataset of real, verifiable trails sourced from publicly available data, including OpenStreetMap (OSM), the National Park Service, and various state and federal geographic information sources. Required data source attributions and license notices are maintained at outsync.io/data-sources. While we make reasonable efforts to verify trail information, on-the-ground conditions change frequently and we do not warrant the accuracy, completeness, or current status of any trail in our dataset. Always verify trail conditions, accessibility, and safety information through authoritative sources before your trip.
Third-Party Trail Imports. Outsync allows you to share or import trail information from third-party applications and services such as AllTrails or other outdoor platforms. By importing such content, you represent and warrant that:

You have the right to share the content with Outsync

Your import does not violate the terms of service of the source application

You will not import content that you know to be inaccurate, unsafe, or misleading
Outsync does not control, verify, or endorse content imported from third-party services. We are not responsible for the accuracy, safety, or legality of any third-party trail data you import. Your use of imported content is at your own risk.
Attribution and Open Data Licenses. Portions of Outsync’s trail dataset are derived from openly licensed sources, including data licensed under the Open Database License (ODbL) by OpenStreetMap contributors. Required attribution and license notices are maintained at outsync.io/data-sources. If you redistribute, export, or otherwise reuse trail data obtained from Outsync, you are responsible for complying with the underlying data licenses.
Third-Party Integrations
Calendar Integrations
Outsync integrates with both Google Calendar and Apple Calendar so you can sync your scheduled hikes with the calendar of your choice.
Google Calendar. By granting Google Calendar permissions, you authorize Outsync to create, modify, and delete calendar events related to your scheduled outdoor activities. Your use of Google services through our app is governed by Google's Terms of Service in addition to these Terms. You can revoke this access at any time through your Google Account settings or through the Outsync Integrations screen, without affecting your Outsync account.
Apple Calendar. By granting Apple Calendar permissions, you authorize Outsync to create, modify, and delete calendar events related to your scheduled outdoor activities. Your use of Apple services through our app is governed by Apple's Terms of Service in addition to these Terms. You can revoke this access at any time through your iOS device settings or through the Outsync Integrations screen, without affecting your Outsync account.
Session Tokens. Calendar integrations use session tokens that may persist across app sessions until you choose to disable the integration. You can disable any integration at any time through the Integrations screen.
Future Integrations
Outsync may, in the future, offer integrations with health and fitness platforms such as Apple Health, Whoop, or similar services. These integrations would be optional, require your explicit consent, and be subject to the additional terms and privacy practices of those platforms. Use of any such future integration will be governed by these Terms together with any platform-specific terms presented at the time of activation.
Notifications and Location Services
Push Notifications and In-App Notifications. With your permission, Outsync sends push notifications and in-app notifications related to your scheduled activities. These may include:

Reminders for upcoming scheduled hikes

Weather forecast updates for scheduled hikes

Updated gear information for scheduled hikes based on changing conditions

Service announcements and account-related messages
Notifications are informational. Outsync does not direct you to take or avoid any specific action regarding your outdoor activities. You are responsible for making your own decisions based on the information provided. You can manage notification permissions at any time through your device settings.
Location Services. Outsync uses your device location, with your permission, to provide location-aware features such as nearby trail recommendations and conditions at trail locations. If you do not grant location permission, you can manually set a location in your User Profile to access these features. You can revoke location permissions at any time through your device settings.
User-Generated Content
Outsync allows you to create and share content within the app, including ratings, written notes about your trail experiences, photos, and other content (collectively, "User Content").
Your Ownership. You retain ownership of all User Content you create or upload.
License to Outsync. By submitting User Content, you grant Outsync a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify (only as necessary to format or display the content), distribute, and display your User Content solely for the purpose of operating, providing, and improving our service. This license terminates when you delete the content or your account, subject to the exceptions described below.
Content Visibility Controls. You control whether your User Content is visible only to you, visible to other Outsync users, or visible to specific groups (where applicable). You can change these settings at any time through the app.
Photos and Identifiable Individuals. If you upload photos that include identifiable individuals other than yourself, you represent that you have obtained any necessary permissions for those individuals to appear in content shared on Outsync.
Aggregated Ratings. Trail ratings you submit may be incorporated into anonymized, aggregated trail rating averages. These aggregated values do not contain personally identifiable information and may persist after you delete your account or remove your individual rating.
Content Removal and DMCA. Outsync may remove User Content that violates these Terms, applicable law, or third-party rights. If you believe content on Outsync infringes your copyright or other intellectual property rights, please contact legal@outsync.io with a description of the content, the rights at issue, and your contact information. We respond to valid notices in accordance with the Digital Millennium Copyright Act (DMCA) and applicable law.
Content Standards. You may not upload User Content that is unlawful, defamatory, harassing, infringing, sexually explicit, hateful, or otherwise harmful. Outsync may remove such content and take action against accounts that submit it.
Future Features
Outsync may, from time to time, introduce additional features, including but not limited to:

Community and social features allowing users to connect, schedule group hikes, invite others to scheduled hikes, share trail recommendations, or follow other users. These features will be governed by these Terms together with any feature-specific terms presented at activation.

Advertising-supported services in which advertisements may be displayed within the app. We do not sell or rent your personal information to advertisers.

Merchandise and other paid offerings in which Outsync may sell physical or digital goods through the app or affiliated channels.

When new features launch, we will update these Terms as needed and notify users of material changes.
Privacy and Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

For users in California, the European Economic Area, the United Kingdom, or other jurisdictions with applicable data protection laws, additional rights and disclosures are described in our Privacy Policy.
Eligibility
You must be at least 13 years old to create an Outsync account. If you are under 18 (or the age of majority in your jurisdiction), you must have permission from a parent or legal guardian to use the service. Outsync is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we become aware that we have collected such information, we will delete it promptly.
Intellectual Property Rights
The Outsync app, including its design, functionality, content, and trademarks, is owned by Outsync LLC and protected by intellectual property laws.
Your Rights:

You retain ownership of any User Content you create or upload, subject to the license described in the User-Generated Content section

You can delete your User Content at any time, subject to the exceptions described in that section
Our Rights:

We own all rights to the app software and service

You receive a limited, non-exclusive, non-transferable, revocable license to use our service for personal, non-commercial purposes

This license terminates when your account is closed or these Terms end
Disclaimers and Limitation of Liability
Important Safety Notice. Outsync provides activity information, scheduling tools, and informational updates. We are not responsible for the safety, quality, suitability, or availability of suggested or imported activities. Outdoor activities, including hiking, carry inherent risks of injury or death. Trail conditions, weather, wildlife activity, and accessibility can change without notice. Information provided by Outsync, including weather forecasts, gear lists, and trail details, is provided for informational purposes only and is not a substitute for your own judgment, current local information, or professional guidance. Always check current conditions, prepare appropriately, and take responsibility for your own safety.

Limitation of Liability. To the maximum extent permitted by law, Outsync LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising from your use of our service or any outdoor activities undertaken in connection with information provided by our service.
Subscription, Advertising, and Payment Terms
Outsync may offer free, advertising-supported, and premium subscription features. Premium features require a paid subscription.
Subscription Terms:

Subscriptions automatically renew unless cancelled

You can cancel your subscription at any time through the app or App Store

Refunds are subject to App Store policies and applicable law

Price changes will be communicated in advance
App Store Purchases. All subscription and in-app purchases are processed through the Apple App Store or Google Play Store and are subject to their respective terms and refund policies.
Advertising. When advertising-supported features are offered, advertisements may appear within the app. Outsync does not sell or rent your personal information to advertisers. Advertising practices are described in our Privacy Policy.
Account Termination
Termination by You:

You may delete your account at any time through the app settings

You can revoke authentication and integration permissions through your provider's settings or through the Outsync Integrations screen

Account data will be deleted according to our Privacy Policy [hyperlink], with the exceptions described in the User-Generated Content section
Termination by Us:

We may suspend or terminate accounts that violate these Terms

We will provide reasonable notice except in cases of serious violations

You can appeal termination decisions by contacting our support team
Upon termination, your right to use the service ceases immediately, but these Terms remain in effect for matters occurring before termination.
Changes to Terms
We may update these Terms from time to time to reflect changes in our service, applicable laws, or business practices. We will notify you of material changes by:

Posting the updated Terms in the app and on our website

Sending you a notification through the app or email

Updating the "Last updated" date below
Your continued use of the service after the effective date of updated Terms constitutes acceptance of the changes.
Governing Law and Dispute Resolution
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Suffolk County, Massachusetts.

If informal resolution fails, disputes will be resolved through binding arbitration administered in Massachusetts

You retain the right to file claims in small claims court for eligible disputes

Class action lawsuits are waived except where prohibited by law
